I have a CCJ. What do I do?

The prospect of having a County Court Judgment (“CCJ”) against you can be an extremely daunting and stressful experience, but there are ways that we can help.

A CCJ is a type of court order that is handed down by a judge sitting in the County Court and is recorded against the person who owes the money. It is the result of someone taking you to court for money that you may owe.

Having a CCJ against you can have a knock-on effect in other areas of your life if you do not act quickly or appropriately. If you have a CCJ against you, your credit rating may be lowered. Banks and loan companies use this information to assess whether to provide a loan. As a result, you may not be able to obtain a mortgage, rent a property, get a credit card, or get a loan, and you may even be refused a job if you intend to work in the financial sector.

To find out whether you have a CCJ against you, you can:

  • Search the Register of Judgments, Orders and Fines (you can do so here); or
  • Obtain a copy of your credit report.

How do I get rid of a CCJ?

If you have a CCJ, the best way to deal with it is to pay it within 30 days of notification. The CCJ will remain on your record for 6 years, and then it will be automatically removed. However, if you do not owe the money and can prove that you don’t, you can apply to have the judgment set aside.

How can we help?

If you do not owe the debt, it may be possible to set aside the CCJ by asking the court to reopen the case. The court can set it aside if you can show that you don’t owe the debt, and the CCJ will be removed from the Register of Judgments, Orders, and Fines. In any event, you need to act QUICKLY!
